SMS Communications Terms of Service

1. Acceptance of Terms

By providing your mobile phone number to Better Health RX Pharmacy ("we," "us," or "our") and consenting to receive text messages — whether through verbal opt-in by phone, verbal opt-in in person, or written opt-in via our patient intake form — you agree to these SMS Communications Terms of Service ("Terms"). If you do not agree to these Terms, do not opt in to receive SMS messages from us.

2. Program Description

The Better Health RX Pharmacy SMS program is a transactional messaging service that sends patients account-related notifications about their pharmacy services. Messages may include:

• Notifications that a prescription is ready for pickup;
• Refill reminders for medications on file;
• Important pharmacy updates such as holiday hours, temporary closures, or service changes;
• Account- and order-related notifications.

This SMS program is operated by Better Health RX Pharmacy and does not include promotional or marketing communications.

3. Consent and Eligibility

To receive SMS messages from us, you must (a) be at least 18 years of age or have the consent of a parent or legal guardian, (b) be the account holder or authorized user of the mobile number you provide, and (c) have a U.S. mobile phone capable of sending and receiving SMS. By opting in, you represent that you meet these requirements. Your consent to receive SMS messages is voluntary and is not a condition of purchase or of receiving pharmacy services.

4. Message Frequency

Message frequency varies based on your prescription activity, typically four to eight (4–8) messages per month. Frequency may be higher during periods of unusual pharmacy activity (such as a recall or pharmacy closure).

To opt out at any time, reply STOP to any message you receive from us. Recognized opt-out keywords include STOP, UNSUBSCRIBE, CANCEL, END, and QUIT. After you reply with an opt-out keyword, you will receive one final confirmation message and no further messages. You may opt back in at any time by contacting the pharmacy.

7. Mobile Carrier Compatibility

Our SMS program is supported by major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages. Service may not be available on all carriers or in all areas. Message and data rates may vary by carrier.

8. Privacy

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Information about your participation in our SMS program is collected, used, and protected in accordance with our SMS Privacy Policy, which is incorporated into these Terms by reference. By opting in, you acknowledge that you have read and understood the SMS Privacy Policy.

9. No Protected Health Information in Messages

SMS messages we send do not contain protected health information (PHI) such as drug names, dosages, or diagnoses. SMS is not a fully secure communications channel. By opting in, you acknowledge that messages may be visible to anyone with access to your mobile device.

10. Disclaimers and Limitation of Liability

Better Health RX Pharmacy is not responsible for any delays, failures in delivery, or any other issues related to the transmission or receipt of text messages. Delivery of text messages is subject to effective transmission by your mobile carrier and is not guaranteed by Better Health RX Pharmacy. By subscribing to our SMS services, you acknowledge and agree that Better Health RX Pharmacy will not be liable for any damages, losses, or injuries arising from or related to the use or failure to receive any text messages, including but not limited to delays, non-delivery, or technical issues. SMS messages are provided on an "as is" and "as available" basis.

Nothing in these Terms is intended to limit any rights you may have under applicable consumer protection laws.

11. Changes to Terms

We may update these Terms from time to time. The effective date at the top of this document indicates when the Terms were last revised. Continued participation in the SMS program after changes constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you may opt out at any time by replying STOP.

12. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the SMS program will be resolved in the state or federal courts located in New York County, New York.
